Archiving of purchase orders and invoices is carried out on a reliable and durable medium that can be produced as proof.

OFFERS AND PROMO CODES

STORE BYBLOSS regularly organizes promotional offers that allow you to benefit from advantageous rates generally in the form of a “promo code” – “Coupon code”. Offers and promo codes cannot be combined, we accept 1 code per order, however you can place several orders with the same promo code. STORE BYBLOSS reserves the right to reimburse you if this condition is not met.

DELIVERY MODALITY

Delivery methods and times offered:

• Colissimo: Delivery within 48 hours at home in France after dispatch of your order *

• Colissimo service point: Delivery within 2 days to the relay point in France after dispatch of your order *

• Chrono Relay: Delivery within 24 hours to the relay point in France after dispatch of your order *

• Chrono post: Delivery within 24 hours at home in France after shipment of your order *

All orders placed before 12:00 p.m. will be dispatched the same day. Beyond that, your order will be shipped the next day.

Orders placed with “in stock” items will only be shipped when the product concerned is available.

For any emergency please contact us by phone so that we can do what is necessary.

The products are delivered to the address indicated by the consumer on the order form and only to the geographical areas that we serve.

All products leave our premises in perfect condition. The customer can report to the carrier (or the postman) the slightest trace of shock (holes, traces of crushing, etc.) on the package, and if necessary refuse the package. A new identical product will then be sent to you free of charge. The consumer is invited to confirm this anomaly by sending us an email, or by telephone in order to take charge of his complaint within 24 hours a day (1) in order to take charge of the complaint under better conditions.

As in any expedition, it is possible to experience a delay or that the product gets lost. In such a case, we contact the carrier to start an investigation. Every effort is made, as long as necessary, to find this package. If necessary, the trader will be reimbursed by the carrier and will deliver a new identical package at his expense.

In the event of delivery to your home or to a relay point, we encourage you to refuse the package and note a reservation on the delivery slip (damage, missing product compared to the delivery note, damaged package, broken products, etc.) and report the refusal to the Seller's Customer Service by email at store@bybloss.com, any order accepted despite the damaged package without proof of repackaging or reservation from the carrier or by the transport services, cannot be the subject of a complaint, you are therefore responsible if you accept the package despite everything.

DELIVERY PROBLEM BECAUSE OF THE CARRIER

Any anomaly concerning the delivery (damage, missing product compared to the delivery note, damaged package, broken products, etc.) We advise you We would like to inform us by email in order to take care of your complaint under the best conditions.

At the same time, the consumer can confirm this anomaly by sending the carrier within (3) two working days following the delivery date a registered letter with acknowledgment of receipt setting out the said complaints. DISTRIBUTED DELIVERY:

Any order indicated as “distributed” will not be subject to a return or a refund.

If you have chosen the economy tracked letter option, you accept that your package be sent in a bubble envelope, with a tracked stamp only. No slip history can be requested. Only a tracking number can be provided to you. However, an inquiry may be made with the carrier.

ORDER AND COMPLAINT:

Any order sent by our services is taken care of by an order picker and is then VERIFIED by another person in order to guarantee your satisfaction and the assurance of a complete order. Your order form must be kept for any claim.

No order is delivered without a purchase order.

Any product started or used cannot be returned or refunded.

DELIVERY ERRORS

The consumer will be able to formulate with STORE BYBLOSS as soon as possible, inform us of any complaint of error of delivery and/or non-conformity of the products in kind or in quality compared to the indications appearing on the order form.

In the event of a delivery or exchange error, any product to be exchanged or refunded must be returned to the STORE BYBLOSS in its entirety and in its original packaging in perfect condition to the ADDRESS of BYBLOSS 472 RUE BATHELEMY THIMONNIER 69530 BRIGNAIS (bat opac)

To be accepted, any return must be reported and have the prior agreement of STORE BYBLOSS, which if agreed will forward the package to the correct address.

The shipping costs are the responsibility of STORE BYBLOSS, except in the event that it turns out that the product does not correspond to the original declaration made by the consumer in the right direction of return.

PRODUCT WARRANTY

The provisions hereof cannot deprive the consumer of the legal guarantee which obliges the professional seller to guarantee him against all the consequences of latent defects of the thing sold.

The consumer is expressly informed that STORE BYBLOSS is not the manufacturer of the products presented on the STORE BYBLOSS SITE.

The warranty period is two years (1 year) from the delivery of the goods for the legal conformity warranty, and 6 MONTHS from the discovery of a hidden defect. Are excluded from this warranty, all products modified or repaired by the customer or by any other entity than the service providers chosen by STORE BYBLOSS

 

RIGHT TO RETRACT

The right of withdrawal applies only to natural persons. STORE BYBLOSS being an online sales site dedicated to professionals, the right of withdrawal does not apply. Indeed, there is no right of withdrawal for companies. Withdrawal for professionals is considered to be a commercial gesture, and will remain exceptional. Warranties against legal latent defects

In accordance with the legal texts in force, the Seller guarantees the Buyer against all the consequences of hidden defects of the thing sold. The Buyer is expressly informed that the Seller is not the producer of the products presented within the meaning of Law No. 98-389 of May 19, 1998 relating to liability for defective products.

The Seller is liable for defects in the conformity of products sold under the conditions of Articles L. 217-4 and following of the Consumer Code and for hidden defects in the thing sold under the conditions provided for in Articles 1641 and following of the Civil Code. The Seller guarantor of conformity is the company BYBLOSS whose address is 8/5 CHEMIN DES TARDS VENUS. The Buyer has a period of 1 year from the delivery of the goods to act. The Buyer can choose between repairing or replacing the good, subject to the cost conditions provided for in Article L. 217-9 of the Consumer Code. It is exempted from providing proof of the existence of the lack of conformity of the good during the 6 months following the delivery of the good. This period is extended to 24 months from the March 18, 2016, except for second-hand goods. The legal guarantee of conformity applies independently of any commercial guarantee granted. The consumer can decide to implement the guarantee against hidden defects of the thing sold within the meaning of article 1641 of the civil code. In this case, he can choose between the resolution of the sale or a reduction of the sale price in accordance with article 1644 of the civil code.

RIGHTS OF USE

The use of trademarks and photos present on the site is strictly prohibited.

FORCE MAJOR

None of the parties will have failed in their contractual obligations, insofar as their execution will be delayed, hindered or prevented by a fortuitous event of force majeure. Will be considered as a case of force majeure any irresistible fact or circumstance, external to the parties, unforeseeable, inevitable, beyond the control of the parties and which cannot be prevented by the latter, despite all reasonably possible efforts.

The party affected by such circumstances will notify the other within ten working days of the date on which it becomes aware.

The two parties will then come together, within three months, unless this is impossible due to force majeure, to examine the impact of the event and agree on the conditions under which the performance of the contract will be continued. If the case of force majeure lasts longer than one month, these general conditions may be terminated by the injured party.

NON-VALIDATION PARTIAL

If one or more stipulations of these general conditions are held to be invalid or declared as such pursuant to a law, a regulation or following a final decision of a competent jurisdiction, the other stipulations will retain their full force. and their scope.

NO WAIVER

The fact for one of the parties not to take advantage of a breach by the other party of any of the obligations referred to in the context of these general conditions of sale cannot be interpreted for the future as a claim to the obligation in question.

APPLICABLE LAW

These general conditions are subject to French law. This is the case for rules of substance as well as for rules of form.

In the event of a dispute or complaint, the consumer will first contact STORE BYBLOSS to obtain an amicable solution.

PROTECTION OF PERSONAL DATA

All the data that you entrust to us is in order to be able to process your orders.

Under law no. 78-17 of January 6, 1978 relating to data processing, files and freedoms, you have with STORE BYBLOSS a right of rectification, consultation, modification and deletion of the data that you communicated to us. This right can also be exercised online.

DISPUTES

Any order placed through STORE BYBLOSS entails the customer's acceptance, without any restriction, of the general conditions of sale of STORE BYBLOSS.

In the event of sale to a legal person, any dispute relating to the sale (price, GTC, products, etc.) will be subject to French law before the Commercial Court of the registered office of STORE BYBLOSS.

Any package not collected at the post office or relay point, and which will be returned to us, will be reimbursed excluding postage and with a penalty of 20% of the total amount of the order.

Packages that have not been collected by the customer at the relay point within the time limits may be subject to different transport circuits by different actors, and may be damaged, we remind you that each package that has left our premises will be returned to the customer's responsibility if necessary.

REFUND AND RETURN

Absence of right of withdrawal for products which have been unsealed by the Buyer after delivery and which cannot be returned for reasons of hygiene and health protection

No refunds will be made. After agreement of the management, returns may be accepted and will be subject to a discount by credit note.

Any parcel not received at the relay point in time is returned to us, if the latter arrives in damaged condition, we discharge ourselves of all responsibility and cannot reimburse the latter.
